Many years ago, my hubby had a property go under contract (representing the seller and the buyer/tenant) with a closing date in 1.5 years. He did a lot of work on the transaction, marketing it several months before the tenants decided to purchase. It was complicated because it also came with land, was a lease option, seller financing and possible sub-dividing terms. There was no animosity between my husband, the seller and buyer.
Finally the day came when we were ready to close and the seller refused to pay the commission! Why? Because the listing agreement had expired 2 months earlier and he believed that since there was no legally binding agreement in effect, he was not obligated to pay.
When we checked with CAR legal department, they agreed!
Yeah, this seller was unethical/immoral. And it happens! So always, add an expiration reminder for ALL of your listings (even if they go pending) on your calendar so you don’t spend a lot of time and money working for free!
